FOIA:Detention Practices Project

Community members from DailyKos and the Booman Tribune are examining several sets of documents obtained under the Freedom of Information Act (FOIA) for evidence relating to the physical abuse and torture of detainees at Guantánamo Bay Naval Base and the denial of legal rights to these detainees under U.S. and international law. This project was started by Susan Hu (at dKos, at Booman).

Combatant Status Review Tribunal Dossiers

Detainees at Guantánamo have been classified as "enemy combatants". When Guantánamo first began to be used as a detention center, detainees had no legal recourse to challenge this status. A U.S. Supreme Court ruling of 2004 forced the U.S. military to convene tribunal review the legal status of Guantánamo detainees. However, the procedure followed by these tribunals is seen by many to be very shaky with regard to the due process rights the Supreme Court intended to enforce with its ruling.

The Associated Press (AP) wire service obtained the dossiers for 59 detainees whose status was reviewed during these proceedings.

Government Detention Records

Seeking evidence with regard to allegations of torture and human rights abuses of U.S. detainees held at overseas detention centers, the American Civil Liberties Union (ACLU) has been working since October 2003 to obtain detention center records and related documents from the U.S. military, intelligence agencies, and Department of Defense. Several recent releases to the ACLU are examined here.
